Your privacy is important to us. It is LincWare's policy to respect your privacy regarding any information we may collect from you through our CopyPlus and ReferralCreate applications (together, the “Apps”).

We collect your name and email address directly from you when you provide it to us. We do not collect any additional information, including information gathered via cookies, pixels, or other tracking technologies. Your name and email address are only used to provide services to you. 

We only retain collected information for as long as necessary to provide you with your requested service. All stored data is protected by commercially reasonable administrative, technical, and physical security controls to safeguard against unauthorized access, disclosure, copying, use or modification.

Our Apps may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites and cannot accept responsibility or liability for their respective security practices.

Permission is granted to installing one copy of CopyPlus and ReferralCreate per device for personal, non-commercial use. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the functionality or materials;
• use Apps for any commercial purpose, or for any public display (commercial or non-commercial);
• attempt to decompile or reverse engineer any software contained in the Apps;
• remove any copyright or other proprietary notations from the materials; or
• transfer the materials to another person or "mirror" the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by LincWare at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must discontinue use of the Apps.

The functionality contained within the Apps are provided on an 'as is' basis. LincWare makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, LincWare does not warrant or make any representations concerning the Apps’ accuracy, likely results, compatibility, security, accuracy, or reliability.

4. Limitations

In no event shall LincWare or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Apps, even if LincWare or a LincWare authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Indemnification

You shall indemnify, defend, and hold harmless LincWare from and against any and all losses, damages, liabilities, and costs (including reasonable attorneys' fees) incurred by you resulting from any third-party claim, suit, action, or proceeding that the Apps, or any use of the Apps or in accordance with this agreement, infringes or misappropriates such third party's US intellectual property rights/US patents, copyrights, or trade secrets, provided that you promptly notify LincWare in writing of the claim, cooperates with LincWare, and allows LincWare sole authority to control the defense and settlement of such claim.

6. Accuracy

The materials appearing in the Apps could include technical, typographical, or photographic errors. LincWare does not warrant that any of the materials on the Apps are accurate, complete or current. LincWare may make changes to the materials or functionality contained in the Apps at any time without notice.

7. Modifications

LincWare may revise these terms of service for the Apps at any time without notice. By using the Apps, you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of New York, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
